Eligibility

You must be at least 16 years old to use GiftHint. By using the Site, you represent that you are of legal age to form a binding contract under the laws of Romania and any applicable local jurisdiction.

Service Description

GiftHint is a web-based tool designed to help users send friendly SMS messages (called “hints”) suggesting gift ideas to their friends or loved ones. GiftHint does not sell physical products or process payments for goods. The Service is provided for entertainment and convenience purposes only.

Pricing

The use of GiftHint’s SMS feature is subject to a one-time fee of 5 USD (plus applicable taxes) per message. The exact amount is automatically converted to your local currency based on real-time exchange rates. Payment processing and currency conversion are securely handled by our authorized partner FastSpring, which ensures accurate local pricing and compliance with regional tax regulations.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Site in any way that violates applicable local, national, or international law.
• Attempt to interfere with, damage, or disrupt the Site or its related systems.
• Use automated tools such as bots, scrapers, or crawlers without authorization.
• Collect or store personal data about other users without their consent.
• Send unlawful, defamatory, or harassing SMS messages via the Service.

Intellectual Property

All content, text, graphics, logos, and trademarks displayed on the Site are owned by GiftHint or its licensors and are protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works based on any materials without our prior written consent.

Warranties and Disclaimer

Refunds

GiftHint does not offer refunds. Fees, if any, related to sending SMS messages are non-refundable, except where required by applicable law.

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Romania. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Romania.

Force Majeure

We are not responsible for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or interruptions in telecommunications or Internet services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
